They are offering laptops and high end electronic items for sale which they do not have.  You send your money to them, they use it, offer excuses about delayed shipping and when you finally realize there is not going to be a shipment, refund your money.  When you post negative feedback they will retaliate with negative feedback and maybe even file an "unpaid item" report with eBay.  In the meantime they have used your money, interest free for 60 days and wasted your time while you wait for your item to arrive.  Some people have reported losing their money and not getting any product.

If you open a dispute (a dispute must be opened within 45 days of your payment) to get your money back do not let them talk you into closing it.  If you close your dispute it can not be reopened and you may be left without your product or your money.

Below are the details of my experience and what I reported to eBays safe harbor department.  I recommend that you do the same.  If you have lost money, you should contact the Police or Sheriff's Office in Elkhart, Indiana.


On December 3, 2007 I used "Buy it Now" to purchase one of the 15 laptops offered on auction #250193900731 by 84disturbed.  It was noted that there may be a 2 week delay in shipping and that they would send an e-mail with an expected ship date within 48 hours.  I received such an e-mail and was told that my machine was due to the week of December 24, nearly 3 weeks from the date of payment.


I did not get any notification of shipping, wrote back but got no response.  On 1/14 I opened a dispute and was told that they had still not received the laptops.  I was asked if I wanted a refund.  I replied that I want the laptop and would wait as long as I could within the limits of the dispute process. To this I received a reply: "Ok Mark, just so you know......you are protected by your credit card company for your purchase. Our company will not allow us to ship while a dispute is in place as paypal takes the payment from us when a dispute is opened. We will need the dispute to be closed before shipping."

That was an obvious lie and would not have been in my best interest to close the dispute without either having the laptop or the money. I responded that if they did not ship the laptop, I would take action. They initiated a refund and closed the dispute.

First, it should be noted that they never had the laptops when they were offered for sale on 11/30--a violation of eBay's pre-sale rules (http://pages.ebay.com/help/policies/pre-sale.html). Even if that could be excused, They certainly knew they were not available on 12/29 when they posted again under #250201518843.  As it turns out, they actually first posted #260183788103 on 11/17 one of the buyers in that sale has given negative feedback for the item he did not receive.

Second, as I clicked "Buy it Now" eBay warns: "You are agreeing to a contract -- You will enter into a legally binding contract to purchase the item from the seller. You are responsible for reading the full item listing, including the seller's instructions and accepted payment methods. Seller assumes all responsibility for listing this item." Isn't the seller also bound by the contract? By not supplying the laptop I purchased, they broke the legally binding contract.

It was eBay's "Power Seller" stamp-of-approval that lead me to buy from this seller.  It follows that nothing less than a removal of that title is the minimum action that should be taken if eBay is to exercise due diligence. However, when you consider that this seller also uses the same tactics under the name e_bobs(see item #170185323048), also promoted as a "Power Seller" and  pre-selling, these people should be suspended. A look at the negative feedback for 84distributed and e_bobs tells a pretty clear story.

I do not know yet if anyone has lost money, but these hucksters are collecting thousands of dollars and using the money for weeks before refunding. It is just wrong.  In addition to the loss of the use of my money, I also lost time in waiting for a laptop which was never to arrive.

Thank you in advance for your attention to this matter. I have saved all the e-mail transactions which I will gladly send if it helps.

If you do take the time to look at the negative feedback for these people you will see very few completed transactions for laptops and other high price items.  There high volume of positive feedback comes from the sale of low price items like memory sticks and other items under $500.  Chances are that you will get your money back if you pursue it properly.  You will get no thanks from them for the six week interest free loan.  You have been warned.
